Beta Programme Terms

These Beta Programme Terms (“Beta Terms”) apply only to participants in the ScoutSocial beta programme, and only for the duration of that programme. They supplement our Terms of Service; where the Beta Terms conflict with the Terms of Service in respect of the beta programme, the Beta Terms govern. Data handling during the beta is described in the Beta Programme Privacy Supplement. These Beta Terms are withdrawn when the beta programme ends.

1. The beta programme

The ScoutSocial beta programme, operated by Aigentifyable LLC (“ScoutSocial”, “we”, “us”), gives selected participants early access to ScoutSocial in order to test functionality and provide feedback. The beta is provided free of charge; no payment is taken during the beta.

Your use of the ScoutSocial platform during the beta is also governed by our Terms of Service (which incorporate our Acceptable Use Policy and Data Processing Agreement). You accept the Terms of Service when you create your ScoutSocial account; these Beta Terms add to, and do not replace, the Terms of Service.

2. Eligibility

Participation is open to adults aged 18 or over. We may accept, decline, or remove participants at our discretion.

3. Beta status — “as is”, no warranty

The beta programme and any pre-release features are provided “as is” and “as available”, and may contain bugs, errors or incomplete functionality. To the maximum extent permitted by law, we make no warranties of any kind regarding the beta, including as to availability, reliability, accuracy, or fitness for a particular purpose. You should not rely on the beta for business-critical activity and should keep your own copies of any important content.

4. Availability and changes

Beta features may be changed, suspended, limited or discontinued at any time, with or without notice. We may modify these Beta Terms during the programme; continued participation after a change means you accept the updated terms. We may end the beta programme, or your participation in it, at any time.

5. Feedback

We welcome your feedback, including bug reports and feature requests. By submitting feedback (including through our forms and feedback tools), you grant ScoutSocial a worldwide, perpetual, irrevocable, royalty-free licence to use, reproduce, modify and incorporate that feedback into our products and services without obligation, attribution or compensation. You confirm that your feedback does not include confidential information of any third party that you are not entitled to share, and that we are free to use it. Feedback is provided on a non-confidential basis, and we have no obligation to treat it as confidential. Feedback is handled as described in the Beta Programme Privacy Supplement.

6. Confidentiality

The beta may give you access to non-public features, functionality and information (“Beta Information”). Unless we say otherwise, you agree to keep Beta Information confidential and not to disclose it publicly, and to use it only for the purpose of participating in the beta. This does not restrict information that is or becomes public through no fault of yours. (Where we run an open community channel such as a Discord server, discussion within that channel is permitted; public disclosure outside it is not, unless we indicate a feature is public.)

7. Acceptable use

Your use of ScoutSocial during the beta remains subject to the Acceptable Use Policy and each Connected Platform's terms. The beta does not expand any rights granted under those terms.

8. Intellectual property

ScoutSocial and all related software, features and materials remain our property (or our licensors'). These Beta Terms do not grant you any ownership in the platform; you receive only a limited, revocable, non-transferable right to use the beta for evaluation during the programme.

9. Limitation of liability

To the maximum extent permitted by law, ScoutSocial will not be liable for any indirect, incidental, special or consequential damages, or for any loss of data, profits or goodwill, arising from your participation in the beta. Nothing in these Beta Terms limits liability that cannot be limited under applicable law.

10. Termination

Either party may end your participation at any time. On termination or at the end of the beta, your access to beta features ceases, and beta-management data is handled as set out in the Beta Programme Privacy Supplement.

11. Governing law

These Beta Terms are governed by the law stated in our Terms of Service, subject to any mandatory consumer-protection rights you have in your country of residence.
